1. Introduction and Acceptance of Terms
Welcome to Promote Zimbabwe (“Promote Zimbabwe,” “we,” “us,” or “our”).
These Terms of Service govern your access to and use of www.promotezimbabwe.com, including its website features, classified advertisements, business listings, promotional services, and any other services we make available through the platform.
Promote Zimbabwe provides an online marketplace where individuals, businesses, and organisations can publish advertisements for products and services and connect with potential buyers or customers.
By accessing our website, creating an account, posting an advert, contacting an advertiser, or otherwise using our services, you agree to be bound by these Terms of Service and our applicable policies, including our Privacy Policy.
If you do not agree with these terms, you must discontinue using the website.
2. About Promote Zimbabwe
Promote Zimbabwe operates an online classifieds platform designed to help users advertise products and services, discover offers, and connect with other users.
Unless expressly stated otherwise, Promote Zimbabwe acts as an advertising and listing platform. We do not own, manufacture, inspect, sell, or directly supply products listed by independent advertisers, nor do we automatically become a party to transactions between buyers and sellers.
Users are responsible for their own listings, communications, negotiations, transactions, and compliance with applicable laws.
3. Eligibility to Use the Website
To use Promote Zimbabwe, you must:
- Be legally capable of entering into a binding agreement.
- Provide accurate and truthful information when registering or using the website.
- Comply with these Terms of Service and applicable laws.
- Use the platform for lawful purposes.
- Have the authority to advertise any products, services, or property you list.
Where a user is under the age of 18, they may use services only where permitted by applicable law and with appropriate involvement or authorisation from a parent or legal guardian. Users must not use the platform in ways prohibited by law.
Promote Zimbabwe reserves the right to restrict access where eligibility requirements are not met.
4. User Registration and Account Security
Some website features may require you to create an account.
When registering, you agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for activities carried out through your account, subject to applicable law.
You must:
- Keep your account information current.
- Protect your password and login details.
- Notify us promptly if you suspect unauthorised access to your account.
- Avoid creating accounts for impersonation, deception, fraud, or abuse.
- Refrain from sharing or transferring your account in a manner that violates these terms.
Promote Zimbabwe may request additional information where reasonably necessary to verify an account, investigate suspected abuse, or protect the platform and its users.
We may suspend or restrict an account where there is reasonable evidence of fraud, impersonation, security risks, or a material breach of these terms.
5. Posting Classified Advertisements
Promote Zimbabwe allows eligible users to publish classified advertisements for permitted products and services, subject to the features and rules of the platform.
When posting an advert, you agree that:
- You have the legal right and authority to advertise the relevant product or service.
- All information provided is accurate, current, and not misleading.
- Photographs, descriptions, prices, and other listing details fairly represent the item or service.
- You will disclose material defects, limitations, conditions, or additional charges relevant to the offer.
- Your listing will not infringe another person’s intellectual property, privacy, or other legal rights.
- You will update or remove an advert when the item is no longer available, has been sold, or the information is no longer accurate, where the platform provides that functionality.
Promote Zimbabwe may edit, reject, remove, or restrict an advert that violates these terms, applicable law, or our advertising policies.
5.1 Unlimited Advert Posting
Promote Zimbabwe may offer registered users the ability to publish unlimited adverts, subject to the features and conditions of the applicable account or service.
“Unlimited” does not mean unrestricted use. Advert posting remains subject to reasonable anti-spam measures, platform capacity, category rules, fraud prevention, and applicable policies.
Users must not abuse this feature by posting duplicate listings excessively, flooding categories, manipulating search results, or repeatedly reposting prohibited content.
We reserve the right to introduce or amend reasonable posting rules to protect the quality, security, and reliability of the platform. Any material changes affecting existing paid services will be handled in accordance with applicable law and the relevant service terms.
5.2 Accuracy of Listings
Advertisers are solely responsible for the content and accuracy of their advertisements.
Prices, product conditions, locations, availability, delivery arrangements, warranties, and other relevant details should be clearly stated. Any claims regarding authenticity, ownership, performance, or condition must be truthful and reasonably supportable.
Promote Zimbabwe does not guarantee that an advert will result in enquiries, sales, leads, or other commercial outcomes.
6. Prohibited Advertisements and Activities
To maintain a safe and trustworthy marketplace, users must not post advertisements or engage in activities involving:
- Illegal goods, stolen property, or products the advertiser is not authorised to sell.
- Counterfeit products or goods that infringe intellectual property rights.
- Fraudulent offers, false claims, deceptive pricing, or misleading descriptions.
- Products or services prohibited by applicable law.
- Weapons, explosives, illegal drugs, or other restricted items, except where a listing is expressly lawful and permitted by our policies.
- Human trafficking, exploitation, or other abusive or criminal activities.
- Unauthorised financial schemes, fraudulent investment offers, or deceptive money-making opportunities.
- False employment opportunities designed to obtain money or personal information fraudulently.
- Harassment, threats, hate-based abuse, or discriminatory content prohibited by applicable law.
- Malware, phishing links, or content designed to compromise another person’s device, account, or information.
- Unauthorised use of another person’s photographs, logos, trademarks, or personal information.
- Spam, repetitive duplicate listings, keyword manipulation, or attempts to interfere with the operation of the website.
Promote Zimbabwe may remove prohibited content, restrict advertising privileges, suspend accounts, or take other appropriate action when violations are identified.
We may also refer suspected criminal conduct to the relevant authorities where appropriate or legally required.
7. Responsibilities of Advertisers and Sellers
Advertisers are responsible for ensuring that their products, services, and business activities comply with applicable laws and regulations.
As a seller or advertiser, you agree to:
- Provide honest descriptions and genuine photographs where applicable.
- Display accurate prices and disclose relevant fees or conditions.
- Respond to enquiries professionally and truthfully.
- Honour agreements you enter into with buyers.
- Ensure that products are legally available for sale.
- Arrange delivery, collection, refunds, warranties, and after-sales support as agreed and as required by law.
- Avoid using the platform to mislead, defraud, or exploit buyers.
Promote Zimbabwe is not responsible for independently verifying every claim made by advertisers. However, we may review listings and respond to complaints in accordance with our policies.
8. Responsibilities of Buyers
Buyers should exercise reasonable care before contacting an advertiser or entering into a transaction.
You agree to:
- Read listings carefully and seek clarification when necessary.
- Verify the identity and credibility of the seller where reasonably possible.
- Inspect products before completing a transaction where practical.
- Confirm the final price, payment method, delivery arrangements, and any additional charges.
- Avoid sharing unnecessary sensitive personal or financial information.
- Use secure payment methods where available and appropriate.
- Report suspected scams, fraudulent listings, or suspicious conduct to Promote Zimbabwe.
Users should be cautious about requests for advance payments, unusual payment arrangements, or pressure to complete transactions without proper verification.
Buyers remain responsible for making informed decisions, subject to their rights under applicable law.
9. Transactions Between Buyers and Sellers
Promote Zimbabwe provides a platform for users to discover advertisements and communicate with one another. Unless we expressly state otherwise for a particular service, we do not act as the buyer, seller, broker, payment processor, delivery provider, or guarantor of a transaction between users.
Any agreement concerning a product or service is generally between the relevant buyer and seller.
Users are responsible for agreeing on:
- The final purchase price.
- Payment terms and timing.
- Product collection or delivery.
- Product condition and specifications.
- Warranties, returns, refunds, and after-sales arrangements.
- Any other terms relevant to the transaction.
Promote Zimbabwe does not guarantee the quality, safety, legality, authenticity, availability, or suitability of items advertised by third parties. Nothing in these terms removes any rights or obligations that cannot legally be excluded under applicable law.
We encourage users to keep appropriate records of their communications, payments, and agreements.
10. Advertising Fees and Paid Services
Promote Zimbabwe may provide free advertising features and may also offer paid services, premium placements, promoted listings, featured advertisements, or other promotional opportunities.
Where a service carries a fee, the applicable price and relevant conditions should be communicated before the user commits to the purchase.
By purchasing a paid service, you agree to pay the applicable charges in accordance with the stated payment terms.
Unless otherwise specified:
- Fees apply to the particular service purchased.
- Payment does not guarantee sales, enquiries, leads, or a particular advertising result.
- Paid advertisements must still comply with these Terms of Service.
- Advertisements may be rejected or removed if they violate our policies or applicable law.
- Any refund, cancellation, or credit will be handled in accordance with the stated service terms and applicable law.
Where a paid service is interrupted or cannot be delivered as agreed, Promote Zimbabwe will address the matter in accordance with its published policies and legal obligations.
We may change our pricing or introduce new paid services. Any changes will be communicated as appropriate, and changes to existing paid commitments will be handled in accordance with the applicable agreement and law.
11. Featured Advertisements and Promotional Services
Promote Zimbabwe may offer options that improve the visibility of selected advertisements, such as featured listings, promoted adverts, or priority placement.
These services are intended to increase exposure but do not guarantee that an advert will appear in a particular position at all times or generate a specific commercial result.
The placement and visibility of advertisements may depend on the selected service, category, duration, relevance, platform functionality, and other operational factors.
Promote Zimbabwe reserves the right to refuse or withdraw promotional services for listings that violate our policies or applicable law, subject to any relevant refund obligations.
12. Intellectual Property Rights
All rights in the Promote Zimbabwe name, branding, logos, website design, original written content, and platform materials belong to Promote Zimbabwe or the relevant rights holders, unless otherwise stated.
Users may not reproduce, distribute, modify, commercially exploit, or otherwise use protected platform materials without appropriate permission, except where permitted by law.
By submitting an advert, photograph, description, logo, or other content to Promote Zimbabwe, you confirm that you own it or have the necessary permissions to use it.
You retain ownership of your content. However, you grant Promote Zimbabwe a non-exclusive, royalty-free licence to host, store, display, reproduce, and distribute that content as reasonably necessary to operate, maintain, promote, and improve the services, including displaying adverts to website visitors and promoting the relevant listing through our own marketing channels.
This licence lasts for as long as reasonably necessary for those purposes, subject to applicable law, your content removal rights, and our Privacy Policy.
You must not submit content that infringes another person’s copyright, trademark, or other intellectual property rights.
We may remove allegedly infringing material and take appropriate action when we receive a credible complaint or identify a violation.
13. Privacy and Personal Information
Promote Zimbabwe recognises the importance of protecting user information.
Information collected through registration, advertisements, enquiries, and use of the website will be handled in accordance with our Privacy Policy and applicable data protection laws, including relevant Zimbabwean legislation.
Depending on how the website operates, information may include account details, contact information, listing content, communications, and technical information necessary to provide and secure the service.
Users must not misuse personal information obtained through the platform, including using it for harassment, unsolicited marketing, identity theft, or other unlawful purposes.
For information about how personal data is collected, used, stored, disclosed, and protected, please refer to our Privacy Policy.
Privacy contact: admin@promotezimbabwe.com
14. Reporting Suspicious Advertisements and Complaints
Promote Zimbabwe encourages users to report suspected fraud, prohibited items, misleading advertisements, impersonation, intellectual property violations, and other breaches of these terms.
Reports can be sent to admin@promotezimbabwe.com.
When submitting a complaint, include as much relevant information as possible, such as:
- The advert title or link.
- The advertiser’s account name, if available.
- A description of the suspected violation.
- Supporting evidence, where appropriate.
We may review reports, request additional information, contact the advertiser, remove content, restrict accounts, or take other reasonable action.
Submitting a report does not guarantee that the reported content will be removed. We will assess reports in light of the available evidence, applicable law, and our policies.
Promote Zimbabwe is not required to resolve every disagreement between buyers and sellers, but we may take action where necessary to protect users and the integrity of the platform.
15. Account Suspension and Termination
Promote Zimbabwe reserves the right to suspend, restrict, or terminate an account, remove an advertisement, or limit access to particular features where reasonably necessary, including when:
- A user materially breaches these terms.
- An advert appears to be fraudulent, illegal, or misleading.
- An account is used to harass, threaten, or exploit others.
- A user repeatedly posts prohibited or abusive content.
- There is evidence of account compromise, security threats, or unauthorised activity.
- Action is required by law or a competent authority.
Where appropriate and legally permissible, we may provide notice of the action and an opportunity to respond or appeal.
Users may request account closure by contacting admin@promotezimbabwe.com. Account closure may be subject to outstanding obligations, lawful retention requirements, and any other applicable conditions.
Termination does not automatically extinguish obligations or liabilities that arose before termination.
16. Website Availability and Changes to Services
We aim to keep Promote Zimbabwe accessible and functional. However, we do not guarantee uninterrupted or error-free operation.
The website may occasionally be unavailable because of maintenance, technical issues, security incidents, service-provider failures, or circumstances beyond our reasonable control.
We may update, modify, introduce, suspend, or discontinue features where reasonably necessary to maintain or improve the platform, comply with legal requirements, or address operational needs.
Where a change materially affects an existing paid service or contractual commitment, we will handle it in accordance with the applicable terms and law.
Users are responsible for maintaining suitable devices, internet access, and security measures when using the website.
17. Disclaimers and Limitation of Liability
Promote Zimbabwe provides the classifieds platform on an “as available” basis, subject to the protections and obligations imposed by applicable law.
To the extent permitted by law, we do not warrant that:
- Every advertisement is accurate or genuine.
- Every advertiser is trustworthy or authorised to sell an item.
- Products or services listed by third parties will meet a buyer’s expectations.
- A listing will result in a sale, enquiry, or business opportunity.
- The website will operate without interruption, errors, or security incidents.
To the extent permitted by applicable law, Promote Zimbabwe will not be liable for indirect or consequential losses arising from users’ reliance on third-party advertisements or transactions between users.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including any applicable consumer rights or liability that cannot lawfully be excluded.
Users remain responsible for exercising appropriate care and conducting their own checks before entering into transactions.
18. Indemnity
To the extent permitted by applicable law, users agree to be responsible for claims, losses, liabilities, and reasonable expenses arising directly from their unlawful conduct, material breach of these terms, infringement of third-party rights, or misuse of the platform.
This provision does not apply to the extent that a claim or loss results from Promote Zimbabwe’s own conduct for which it is legally responsible, and it does not override any rights or protections that cannot lawfully be waived.
19. Third-Party Websites and Services
The Promote Zimbabwe website may contain links to third-party websites, payment services, social media platforms, or other external resources.
These services may be operated by organisations independent of Promote Zimbabwe. We do not control all third-party content, policies, security practices, or services.
Accessing an external website or using a third-party service is at your own discretion and may be subject to that provider’s terms and privacy policy.
The inclusion of a link does not necessarily constitute an endorsement by Promote Zimbabwe.
20. Changes to These Terms
Promote Zimbabwe may revise these Terms of Service from time to time to reflect changes in our services, business practices, security requirements, or applicable law.
When changes are made, we will update the terms on our website and revise the effective date where appropriate.
Material changes will be communicated through reasonable means where required by law or appropriate in the circumstances.
Your continued use of the website after revised terms become effective will be subject to the updated terms, to the extent permitted by applicable law. Where fresh consent is legally required, we will seek it.
We encourage users to review this page periodically.
21. Governing Law and Dispute Resolution
These Terms of Service shall be governed by the laws of Zimbabwe, subject to any mandatory legal requirements that apply.
If a dispute arises concerning the use of Promote Zimbabwe, users are encouraged to contact us first so that the matter can be discussed and, where possible, resolved amicably.
Any dispute that cannot be resolved through reasonable communication may be referred to the competent courts or other appropriate dispute-resolution mechanisms in Zimbabwe, in accordance with applicable law.
Nothing in this section prevents a user from exercising a statutory right to seek assistance from a relevant regulator, consumer protection body, or court.
22. General Provisions
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure by Promote Zimbabwe to enforce a provision immediately does not mean that we waive our right to enforce it later.
These terms, together with the applicable Privacy Policy and any additional terms presented for specific services, constitute the agreement governing your use of the website, to the extent permitted by law.
Users may not transfer their rights or obligations under these terms without our consent where such consent is required. Promote Zimbabwe may transfer or restructure its operations in accordance with applicable law, provided that users’ legal rights are respected.
Nothing in these terms creates a partnership, employment relationship, agency, or joint venture between Promote Zimbabwe and an independent user or advertiser.
